Violations of the 10th and 4th Amendment
Hello there again readers and welcome back to Coffee Break Liberty, a blog where we tackle books, news and many other things under the sun where liberty is a guiding principle. Last week it was announced that the DOJ under attorney general Jeff Sessions would be looking into eliminating of some President Obama era restrictions. These restrictions and rules, that might be eliminated, essentially allowed states that had made the use of marijuana legal, to operate without fear of federal intervention. Of course though we can’t have that it seems with Jeff Sessions running the DOJ. Sadly it should almost come as no surprise that the federal government wants to continue to attack the rights of the people and the states. With the change in stance by the DOJ it is clear they plan to ignore the constitution and the 10th amendment for starters. The federal government does not have the constitutional authority to declare a plant to be illegal. Additionally, if that wasn’t enough, the 10th amendment ensures that all powers not given to the federal government are left up to the states. Again though, time after time we see a government ignoring our rights. Many though will argue that the supreme court ruled that the federal government could actually do these things. This then brings up another issue, if we look to the constitution about the judicial branch no where does it give the supreme court’s opinion the weight of law. The supreme court’s opinion is just that, an opinion not law.
If the violation of the 10th amendment wasn’t bad enough the 4th amendment too is being violated and about to be battled out on the senate floor. The FISA surveillance program is about to expire and will be debated in the senate before the expiration date on 19 JAN. To quickly summarize it, the program allows federal agencies to violate your privacy without a warrant. Additionally even if a warrant is issued, it will rarely have the person’s name on it but rather just a broad brush stroke. The 702 surveillance program has passed the house and will now be headed to the senate. There is one man that has already promised to fight the extension in the senate, Senator Rand Paul. With the extension now headed to the senate we will be looking to Sen. Paul to try and filibuster this awful program’s renewal. The 702 program is a violation of the 4th amendment and must be stopped. It must end. Get a warrant.
Our rights are being violated left and right, this needs to end. This year being an election year gives us the opportunity to change this! We need to be looking for liberty minded candidates this primary season and all the way to election. We are a voice that will be heard. We can’t let 2018 be a year where we sit on the sideline.
